Sp?rsm?let om overleveringsregelen (tradisjonsprinsippet) i den dynamiske formueretten er kontroversielt. Det dreier seg om regelen om at det i utgangspunktet ikke kan oppn?s s?rlige rettigheter i l?s?re i konkurs dersom l?s?ret befinner seg hos konkursdebitor ved bo?pningen. Overleveringsregelen finnes b?de i norsk og svensk rett, men detaljene er ganske forskjellige. Professor Claes Martinson, G?teborgs universitet innleder om emnet.
